Alcance de las acciones afirmativas y protección del derecho a la igualdad ante la ley. Una revisión sistemática

Las acciones afirmativas son instrumentos jurídico-políticos destinados a corregir desigualdades estructurales y promover la igualdad material. Esta revisión sistemática analizó su alcance en la protección del derecho a la igualdad ante la ley, identificando tendencias, limitaciones y efectos en diversos contextos sociojurídicos. Se aplicó la metodología PRISMA 2020, realizando búsquedas en bases de datos como Scopus, Web of Science y SciELO, utilizando descriptores como "acciones afirmativas" y "igualdad sustantiva". Se seleccionaron 34 estudios originales publicados entre 1988-2025, tras aplicar criterios de elegibilidad que priorizaron investigaciones con análisis normativo o constitucional. Los resultados evidencian que las acciones afirmativas han incrementado significativamente la inclusión de grupos históricamente discriminados en educación y empleo. No obstante, su efectividad es contexto-dependiente y enfrenta desafíos como resistencia institucional y falta de evaluación de impacto. La jurisprudencia ha reconocido su legitimidad, estableciendo criterios de proporcionalidad y temporalidad. Se concluye que estas medidas son esenciales para materializar la igualdad sustantiva, aunque requieren marcos de seguimiento robustos, diseños contextualizados y mayor investigación empírica sobre sus efectos a largo plazo.Downloads
